تمام امیدواروں کو آرٹیکل 62 ، 63 کی چھلنی سے گزرنا ہوگا اور 218/3 اور 1976ءکے عوامی نمائندگی ایکٹ کی شق 77 سے 82 اور سپریم کورٹ کے انتخابی اصلاحات کے فیصلے پر عمل درآمد ہوگا۔ انقلاب کا سفر ابھی جاری ہے اور ہم معاہدے پر عمل درآمد ہونے تک اپنی جدوجہد جاری رکھیں گے۔ہونا کچھ بھی نہیں۔ پھر انہی لوگوں نے اسمبلیوں میں آ جانا ہے۔ بہت ہوا تو چہرہ بدل جائے گا، لیکن ہو گا وہی کچھ جو اب تک ہوتا آیا ہے۔ بڑی حد ہوئی تو 10 سے 20 فیصد تبدیلی آئے گی۔

کیا واقعی ایسا ہو گا؟ اگر ایسا نہ ہوا تو اگلا لائحہ عمل کیا ہو گا؟
کیا واقعی ایسا ہو گا؟ اگر ایسا نہ ہوا تو اگلا لائحہ عمل کیا ہو گا؟
کیا قادری صاحب کی نطر میں یہ "یزیدی، کرپٹ، اور جھوٹے" لوگ معاہدے پر پورا عمل کریں گے؟
کیا آج تک پی پی نے کبھی کوئی معاہدہ پورا کیا؟ کیا زراری اور پروز اشرف ٓئین کی دفعہ ۶۲ ۶۳ پر پورا اترتے ہیں، اس معاہدے کی قانونی حیثیت کیا ہے؟ کیا جن تبدیلیوں کی بات کی جارہی ہے ان کو ٓئین سپورٹ کرتا ہے یا جو ایک نام نہادہ معاہدہ کیا گیا اس پر حکومت آئین کے تحت مجبور ہے کہ عملدرآمد کرے

ISLAMABAD: While the supporters of Dr Tahirul Qadri are celebrating their triumph after the deal with the government, country’s top legal and constitutional experts see no legal value of ‘Islamabad Long March Declaration’.The agreement signed between the government and Qadri stipulates that two names will be proposed for the caretaker prime minister with complete consensus between Qadri and the government. It denotes that the issue of composition of the Election Commission of Pakistan (ECP) will also be discussed between the two parties.Former Law Minister Dr Babar Awan termed it as an ultra-constitutional arrangement. “Principle of jurisprudence and statute is that where there is a constitutional dispensation it cannot be substituted by an ultra-constitutional arrangement in the name expediency,” Awan told The News.He said the incumbent national and provincial governments have absolutely no relevance or nexus with the holding of general elections as this is an exclusive domain of two constitutional bodies. “First under part VIII, article 213 to 226, it is the constitutional mandate of Election Commission and also the caretaker set-ups and cabinet.”Awan was of the view that the present government is a guest for seven more weeks; therefore the new caretaker set-up can over-rule Islamabad declaration and may formulate itsown election policies.“For holding elections as well as caretaker setups, our constitution being alive, the vibrant document does not recognise any step in the name of doctrine of necessity,” he said.Former Supreme Court judge Justice (R) Wajihuddin Ahmed said the declaration is not of a binding nature.” This is just like an agreement between two private parties. The office of the President or the Prime Minister is not bound to uphold this deal. It is signed in individual capacities,” he said.However, Justice (R) Wajihuddin said the declaration has some legal importance as it promises to implement some election reforms stipulated under the constitution. He said the agreement has left some key issues un-attended.“The issue of corruption is completely ignored. Dr. Tahirul Qadri signed deal with same people whom he criticised in his speech on 23rd December.”Former Balochistan High Court judge and former president of the Supreme Court Bar Association, Justice (R) Tariq Mehmood, said the agreement was a face-saving arrangement for Qadri and has no legal value.“If the agreement is not implemented by the government, Qadri cannot challenge it in any court of law,” he said.He was of the view that the declaration will not bring any significant changes to electoral laws as a constitutional amendment is needed to do the same.“A panel of legal experts, proposed the agreement cannot amend the constitution,” he said adding that the electoral reforms propagated by Qadri have already been introduced by the Supreme Court through a judgment on June 8, 2012.He said the long march was launched by Tehreek Minhajul Quran which is not a political party but surprisingly the agreement is signed by Pakistan Awami Tehrik (PAT).“I am not sure that even PAT fulfils all the requirements of a political party under the constitution and Election Commission rules” he said.Justice (R) Tariq Mehmood urged the parliament to formulate a law prohibiting presence of minors in any future protest. “It is the responsibility of state to protect minors.”He also proposed a law under which a protest site is allocated in each big city of the country so that the rights of ordinary citizens are not violated by protesters in future.Senior legal mind Athar Minallah termed the declaration a farce. “The declaration is a useless piece of paper and a farce, designed to befool people” said Minallah.“The constitution states that caretaker Prime Minister will be appointed after consultation between the leader of house and leader of the opposition. However, under the declaration, leader of the opposition is not part of consultation.”He said the government has set a dangerous precedent by bowing to a pressure group.
