America Has Decided
To Make America Great Again!
Donald Trump has confounded all of the
pollsters and pundits and pulled off a shock election victory over his opponent Senator Hillary Clinton. Right up until the very last moment all of the major polls were predicting a Hillary win, but as the night unfolded it was not to be Hillary’s night. So what happens now?
Well, the Presidential Inauguration will take place in Washington D.C. Friday January 20th 2017. So President Obama will be President right up until that transition. President Elect Donald Trump cannot really do anything until he takes the reigns of office and then he will have to make some decisions.
As an Immigration law firm dedicated to helping people emigrate to the US, we are naturally concerned as to what a President Trump will do, since he has long stated that he does not have a positive inclusive position on US Immigration. Nevertheless, there is only so much a President can actually do. For example, the President cannot pass any laws, instead it’s the House of Representatives and the Senate collectively known as Congress who can bring legislation to the floor and vote on it. The President can then either sign it into law or veto it (block) but the President is not the one who writes laws.
The bulk of our clients are highly educated professionals, investors and entrepreneurs. Silicone Valley and the Oil & Gas Industry and other US high skilled industries around America are still desperate for foreign workers to fill these vacancies. It would be our view that the skilled workers will still be welcome, desired even, to come and work in the US.
In contrast, for low-skilled, would-be migrants our view is that they should still find a welcome in the US. Despite President Elect Trump’s rhetoric of being anti-immigrant without an ample supply of low-skilled foreign workers, especially in food and agriculture, American’s would literally starve; we simply need the food harvested, it’s not going to harvest itself.
So if America needs the highly-skilled and the low-skilled, who is President Elect Trump really after in his anti-immigrant rhetoric? Trump has said, he is after the criminal, undocumented gangs, then he wants to secure the border by building a wall and having Mexico pay for it and then after all that has been done, he then wants to remove or “do something” about the 12 million undocumented aliens in the US. Let’s think about that for a moment.
Any wall covering the Southern border would most likely take many years to construct and cost billions of dollars. Any wall would certainly take longer than a single presidential term to complete. It is of course doubtful that Mexico really would pay for any wall, and it’s also doubtful that Congress would pass legislation that would have American’s foot the bill.
Given that President Elect Trump does not want to even begin to tackle the 12 million undocumented workers until after the wall has been built, it’s not clear what any undocumented alien who has not committed any crime has to fear. Albeit, a life in the shadows of being undocumented is certainly no picnic.
What about the Muslim ban? Again, no matter what any President might want to do he or she cannot act outside the Constitution. Indeed, Congress cannot pass any law that violates the Constitution. Attempting to ban a singular race or religion of people for any reason has already been declared unconstitutional and thus could not be made law. In truth, soon after President Elect Trump announced the “Muslim ban” he had to begin backing away from it because of its unconstitutionality.
Comprehensive Immigration Reform? It’s impossible to guess whether there will be any kind of Comprehensive Immigration Reform in this upcoming presidency. Immigration reform to address the wide range of immigration visas and green card pathways has not really been discussed or debated in Congress from the Republican side in many years as the focus has always been on undocumented aliens. I guess we’ll have to wait and see. In the meantime, America cannot be great without immigrants whether high or low-skilled - we absolutely need them.
So let’s not get too alarmed about President Elect Trump, at least as his presidency pertains to US Immigration policy. We certainly wish him every success.
